Відзначено генетичний зв'язок вітчизняного законодавства з системою європейських законодавчих актів.; EN: The article defines the special position of rail transport. The analysis of the scientific heritage of leading Ukrainian and foreign scientists on the gradual formation of transport legislation. The necessity of special regulation of economic, organizational and legal foundations of the railway complex, determination of its place and role in the economy and social sphere, its relations with state authorities, owners of railway transport facilities, rail transport relations, shippers, consignees, passengers and other types of transport . The expediency of the development of new approaches to the solution of these problems has been substantiated. The essence and stages of the formation of the current Charter of the railways of Ukraine are investigated. The relationship of the current Charter of the railways of Ukraine with the railway law system of almost all European continental states, drawn up in the international convention on the carriage of goods by rail (the so-called Bern Convention) and the history of the Bern Convention, is considered The main achievements of the Bern Convention are noted. The integrity and consistency of the process of formation of domestic transport legislation is indicated. A historical review of the main legislative and regulatory documents in force in transport has been carried out and the stage-by-stage nature of their formation and development has been investigated using the historical method. Transport and legal phenomena have been studied, comparing and defining their characteristics, identity or difference both at the state level and at the level of different countries. Genetic connection of the national legislation with the system of European legislation is noted. It was noted about the extension of the formation of a system of regulatory documents that establish the organizational and legal basis for the activities of railway transport at the present stage. The influence of the main factors on the increase in financial resources of enterprises of the industry for the production of investment goods is determined It is proved that the rise in prices adversely affects the dynamics of investment processes, requires significant amounts of funding. Inflation undermines the incentives for a massive renewal of capital on a new technical basis, since the level of profit becomes hardly predictable due to the difficulties in determining the difference between the value of production costs and wholesale prices. As a result, the course of restructuring of industrial production slows down. Analysis of the movement of producer prices for engineering products in the developed EU countries suggests that in countries with low price growth rates there are more favorable conditions for realizing the requirements of scientific and technological progress in the structure of industrial production. The significant price increase during the economic crisis period holds back the next renewal of fixed capital, undermines the incentives to improve technology. For Ukrainian engineering enterprises producing investment products, high rates of price growth are characteristic. Particularly high rates of growth in prices for products of enterprises producing electrical equipment. It should be noted that the advantage in the growth of prices was obtained mainly by monopolies in the production of commodities and goods with a low degree of processing, while the branches of the investment engineering industry, in particular the enterprises for the production of electrical equipment, computers, electronic and optical products, which are designed to determine the country's economic potential. It is determined that the investment risk at the enterprises of railway transport is associated with the probability of financial losses in the form of lost profit or loss of capital, due to the uncertainty of the investment conditions and, accordingly, the inability to prevent these losses. Systematic investment risk characteristics as the sources, the nature of the manifestation in time, the level of financial losses, the ability of foresight, validity, possibilities of prevention and control, degree of validity, the possibility of compensation of losses, areas of identification, factors of influence. The investment risk management system is characterized as a set of methods, techniques and measures that allow to predict to a certain extent the occurrence of risk events and take measures to exclude or reduce the negative consequences of such events. The requirements for the formation of the investment risk management system at the enterprises of the railway industry are clarified. The stages of investment risk management, including: risk identification; identification of sources and volumes of information; definition of criteria and methods of risk analysis; development of measures to reduce risks; risk monitoring; retrospective analysis of risk management. It is concluded that the assessment of investment risks is based on the theory of probability, mathematical statistics, theory of operations research, and ensuring the effectiveness of evaluation requires the involvement of the entire Arsenal of methods of quantitative and qualitative assessment of investment risks. The tools of investment risk management, namely such common methods of neutralization of investment risks as risk avoidance, insurance, self-insurance, diversification, limitation, hedging and distribution of investment risks.
