Стан і напрями удосконалення механізмів оренди рухомого складу АТ «Укрзалізниця» в умовах функціонування електронної системи Prozorro.Продажі

Abstract

UA: У статті здійснено розширений комплексний аналіз сучасного стану нормативно-правового, організаційно-економічного забезпечення оренди рухомого складу ПАТ «Укрзалізниця» в умовах імплементації Закону України № 157-IX «Про оренду державного та комунального майна». Доведено, що основні локальні нормативно-правові акти, які формально регулюють передавання вантажних вагонів в оренду, розроблені за попереднім законодавством і на сьогодні не забезпечують повної відповідності Закону № 157-IX, Порядку № 483 і Методиці № 630, а також не враховують особливості правового режиму воєнного стану. Обґрунтовано основні напрями удосконалення механізмів оренди рухомого складу. Запропоновано оновлення Інструкції про порядок передавання вантажних вагонів в оренду з урахуванням нової нормативної бази, розроблення галузевого Порядку проведення електронних торгів з оренди рухомого складу, а також концепцію інтеграції механізмів класичної оренди вагонів із чинною моделлю продажу послуг через Prozorro.Продажі. Сформульовано підходи щодо диференціації інструментів доступу до вагонного парку для різних груп користувачів (великих експортерів, промислових підприємств, малих і середніх вантажовідправників).

EN: The article provides an in-depth and extended analysis of the current state of the legal, organizational and economic as well as institutional mechanisms governing the lease of rolling stock of JSC «Ukrzaliznytsia» under the Law of Ukraine No. 157-IX «On Lease of State and Communal Property» and within the framework of the Prozorro.Sale electronic trading system. It is demonstrated that, despite the formal completion of a new national model for leasing state property based on competitive electronic auctions, there remains a significant gap between the statutory requirements and the actual practice of granting access to Ukrzaliznytsia’s wagon fleet. The study shows that the core internal regulations of JSC «Ukrzaliznytsia» that nominally govern the lease of freight wagons were drafted under the previous legal regime and therefore do not fully comply with Law No. 157-IX, Government Resolution No. 483 and the Lease Fee Methodology No. 630 and do not adequately reflect the specific legal regime of martial law. At the same time, the model of selling services for the use of wagons through Prozorro.Sale, which has been actively employed since 2018– 2019, is focused mainly on short-term temporary use of rolling stock and does not create a full-fledged legal status of a lessee for clients. Drawing on a critical review of Ukrzaliznytsia’s internal regulations, an overview of the dynamics of electronic auctions, and the identified conflicts between special railway legislation and general lease regulations, the paper substantiates the main directions for improving rolling stock leasing mechanisms. These include updating the Instruction on the procedure for transferring freight wagons for lease in line with the current legal framework, developing a sector-specific Procedure for conducting electronic auctions for rolling stock lease, and designing a concept for integrating classical lease instruments with the existing service-sale model via Prozorro.Sale. The article proposes approaches to differentiating access tools to the wagon fleet for various user groups (large exporters, industrial enterprises, small and medium shippers), thereby combining the flexibility of short-term temporary use with the long-term predictability of classical lease contracts. It is argued that the implementation of the proposed measures will bring wagon lease relations of JSC «Ukrzaliznytsia» into full compliance with the current legislation, enhance transparency and competitiveness of access to rolling stock and strengthen the adaptability of rail transport to the challenges of wartime and post-war recovery.
